1. Purpose and Acceptance

These General Terms and Conditions of Use (hereinafter the "T&Cs") govern access to the website accessible at the address www.scob-brewery.be (hereinafter the "Site") published by SCOB Brewery SRL, whose registered office is located at Rue Dieudonné Lefèvre 4, 1020 Brussels, registered with the Crossroads Bank for Enterprises under number 1012.088.201 (hereinafter "SCOB Brewery" or “we”).

Any use of the Site implies full, complete and unreserved acceptance of these T&Cs. If you do not agree to these terms, we invite you not to use the Site.

2. Access to the site

The Site is accessible to any user with access to the Internet. The costs related to this access (computer equipment, connection, etc.) are the responsibility of the user.

SCOB Brewery reserves the right to modify, suspend, restrict or interrupt access to the Site, without notice, in particular in the event of technical maintenance or updates.

3. Site Content

The Site offers institutional, commercial and promotional information on SCOB Brewery's products, including craft beverages, events, an online store area and a contact form.

All texts, illustrations, photographs, videos, logos, and other content on the Site are protected by applicable law (see section 9 of these T&Cs).

These T&Cs are originally written in French. In the event of a translation, only the French version will prevail in the event of a dispute.

4. Use of the Site

The user undertakes to:

• Use the Site in a manner that complies with applicable laws and regulations;

• Not to infringe the rights of third parties or public order;

• Not to voluntarily introduce viruses or any other malicious elements;

• Not attempt to fraudulently access the systems or data of the Site or any user.

In the event of non-compliance with these obligations, SCOB Brewery reserves the right to suspend or restrict access to its services, or even to take any necessary legal action.

5. User account and online ordering

Some of the Site's services, in particular the online store, require the creation of a customer account. The user undertakes to provide accurate, up-to-date and complete information, and to maintain the confidentiality of his username and password.

SCOB Brewery shall not be liable for any fraudulent use of the account resulting from a breach of these obligations.

6. Hypertext links

The Site may contain links to other websites or external resources. SCOB Brewery is not responsible for the content, privacy policy, or any harm resulting from visiting these third-party sites.

7. Protection of personal data

The use of the Site involves the collection and processing of certain personal data. To learn more about the nature of this processing, the rights of users and the protection measures put in place, please consult our Privacy Policy.

8. Liability

SCOB Brewery strives to ensure the accuracy of the information published on the Site. However, errors or omissions may occur. The Site is provided "as is" and without warranty of any kind.

SCOB Brewery cannot be held liable in the event of:

• Technical malfunctions beyond its control;

• Loss of data or damage to the integrity of the user's computer system;

• Wrong, outdated, or incomplete content;

• Unlawful or improper use of the Site by a user.

9. Intellectual Property

All elements accessible on the Site, including, but not limited to, texts, photographs, visuals, videos, illustrations, graphics, logos, pictograms, animations, recipes, product sheets, sound elements, databases, as well as the general structure of the Site, its tree structure, its graphic charter and its source code, are the exclusive property of SCOB Brewery SRL or are subject to rights of use granted by SCOB Brewery SRL third parties.

As such, any reproduction, representation, adaptation, translation, modification, extraction, reuse, or exploitation (in whole or in part) of the Site or any of its elements, by any process whatsoever, on any medium whatsoever, without the prior written authorization of SCOB Brewery, is strictly prohibited and constitutes an infringement within the meaning of applicable law, likely to engage the liability of its author.

9.1 Operating Name

The name "SCOB Brewery" is a protected trade name within the meaning of applicable law. As such, any unauthorized use of this name in a context likely to create a risk of confusion in the mind of the public or to take undue advantage of the company's reputation may be subject to prosecution for unfair competition or parasitism.

9.2 Copyright

SCOB Brewery SRL is the owner or assignee of the economic rights relating to the original content published on the Site.

Any unauthorized use of these protected works, even partial or for non-commercial purposes, constitutes copyright infringement.

9.3 Rights to photographs and multimedia content

The photographs, illustrations, videos, and audiovisual elements broadcast on the Site are protected by the intellectual property rights of their authors or beneficiaries. Unless explicitly stated otherwise, SCOB Brewery owns the rights to broadcast the site. Any reuse or reproduction is prohibited without express permission.

10. Changes to the T&Cs

SCOB Brewery reserves the right to modify these T&CS at any time. The user is invited to consult them regularly.

11. Applicable law and jurisdiction

These T&Cs are governed by Belgian law. Any dispute relating to their interpretation, execution or validity falls within the exclusive jurisdiction of the courts of the judicial district of Brussels, unless otherwise stipulated.
